Welcome to Workly. These Terms & Conditions ("Terms") govern your access to and use of the Workly platform, including our website, mobile applications, and related services (collectively, the "Platform").
By accessing or using Workly, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1. About Workly
Workly is a service marketplace platform that connects Customers with Service Providers (individual professionals and businesses) for on-demand and scheduled services, including but not limited to:
- Book by Hour / Day
- Diagnostic Visits
- Emergency Services
- Request-a-Quote services
Workly acts as a technology platform only and does not directly provide services.
2. Eligibility
To use Workly, you must:
- Be at least 18 years old
- Provide accurate, current, and complete information
- Have legal authority to enter into contracts
Service Providers must also complete identity, compliance, and verification requirements as applicable.
3. Account Registration
3.1 User Accounts
You are responsible for:
- Maintaining confidentiality of your login credentials
- All activities that occur under your account
You agree to notify Workly immediately of any unauthorized use.
3.2 Account Suspension or Termination
Workly may suspend or terminate accounts if:
- False or misleading information is provided
- Platform misuse or abuse is detected
- Legal, compliance, or safety violations occur
4. Services & Bookings
4.1 Role of Workly
- Workly facilitates service discovery, booking, communication, and payments
- Workly is not a party to the service contract between Customer and Provider
4.2 Booking Types
Available booking flows may include:
- Scheduled Hour / Day services
- Diagnostic visits
- Emergency bookings
- Request-a-Quote workflows
Each booking type may have different rules, timelines, and payment terms.
5. Pricing & Payments
5.1 Payments
- Payments are processed via third-party payment processors (e.g., Stripe)
- Diagnostic fees, escrow amounts, or advance payments may apply
5.2 Escrow & Release
For applicable bookings:
- Payments may be held in escrow
- Funds are released to Providers upon job completion or milestone confirmation
5.3 Taxes
Providers are solely responsible for:
- Applicable taxes, GST/VAT, or statutory charges
- Compliance with local tax laws
6. Cancellations, Rescheduling & Refunds
Cancellation and refund policies may vary based on:
- Service type
- Booking stage
- Provider acceptance status
Applicable cancellation fees or refund rules will be displayed at booking time.
7. Service Provider Obligations
Service Providers agree to:
- Deliver services professionally and safely
- Provide accurate service descriptions and pricing
- Comply with applicable laws, licenses, and regulations
- Maintain valid KYC, verification, and compliance status
Workly reserves the right to limit visibility or access for non-compliance.
8. Customer Responsibilities
Customers agree to:
- Provide accurate service requirements and location details
- Ensure safe access to service locations
- Communicate honestly and respectfully
Workly is not responsible for issues arising from incorrect information provided by Customers.
9. Ratings, Reviews & Feedback
- Users may submit ratings and reviews after service completion
- Reviews must be truthful and respectful
- Workly may remove reviews that are abusive, misleading, or violate platform policies
10. Prohibited Conduct
You agree not to:
- Bypass Workly to complete transactions off-platform
- Misuse, scrape, or reverse engineer the Platform
- Harass, threaten, or abuse other users
- Upload false, illegal, or harmful content
Violation may result in account suspension or permanent removal.
11. Intellectual Property
All Platform content, including:
- Logos, trademarks, UI, design, code, and content
are owned by or licensed to Workly.
You may not copy, distribute, or exploit any content without permission.
12. Third-Party Services
Workly integrates third-party tools (e.g., payments, maps, identity verification).
Workly is not responsible for third-party service availability or failures.
13. Disclaimers
- Services are provided by independent Providers
- Workly does not guarantee service quality, completion, or outcomes
- Platform availability may vary due to maintenance or external factors
14. Limitation of Liability
To the maximum extent permitted by law:
- Workly is not liable for indirect, incidental, or consequential damages
- Workly's liability is limited to the fees paid through the Platform for the relevant booking
15. Indemnification
You agree to indemnify and hold harmless Workly from any claims, losses, or damages arising from:
- Your use of the Platform
- Violation of these Terms
- Disputes with other users
16. Privacy
Your use of Workly is subject to our Privacy Policy, which explains how we collect, use, and protect your data.
17. Modifications to Terms
Workly may update these Terms periodically.
Continued use of the Platform after updates constitutes acceptance of revised Terms.
18. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the applicable operating jurisdiction of Workly.
Disputes shall be subject to exclusive jurisdiction of the competent courts.
